Welcome to FixCity, a comprehensive civic infrastructure issue reporting and tracking platform operated by Aviatech Solutions LLP, a Limited Liability Partnership registered under the Limited Liability Partnership Act, 2008 in India. 3. Service Description

FixCity is a multi-tenant platform where citizens can report local infrastructure issues and track their resolution status. Each city operates on its own subdomain with localized content and data.

3.1 Core Services

  • Issue Reporting: Report potholes, garbage, water leaks, street lighting, and other civic problems
  • Photo Evidence: Upload images to document infrastructure issues
  • Location Mapping: Pinpoint exact locations using interactive maps
  • Issue Tracking: Monitor resolution status and municipal responses
  • Community Voting: Vote on issues to amplify community priorities
  • Comments & Discussion: Collaborate with other citizens on reported issues
  • Analytics Dashboard: View trends and statistics about civic problems in your area
  • Leaderboard: Track top contributors and active community members

3.2 Service Limitations

While we strive to facilitate effective civic issue resolution, users must understand that our Service enables reporting and tracking but does not guarantee resolution by municipal authorities. We cannot control the response times or actions of government bodies. Issue resolution depends on municipal resources, priorities, and jurisdictional policies.

4. User Eligibility and Registration

4.1 Eligibility Requirements

To use our Service, you must meet the following eligibility criteria:

  • Be at least 18 years of age or have reached the age of majority in your jurisdiction
  • Have the legal capacity to enter into binding contracts
  • Not be prohibited from using our Service under applicable laws

  • Personalization: Service personalization will be reset to default settings

8. Intellectual Property Rights

All content, features, and functionality of FixCity, including but not limited to text, graphics, logos, images, software, and their selection and arrangement, are owned by Aviatech Solutions LLP and are protected by intellectual property laws including copyright, trademark, trade secret, and patent rights.

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable license to access and use our Service for your personal, non-commercial use. This license does not include any rights to reproduce, distribute, modify, or create derivative works.

You retain ownership of any intellectual property rights in content you submit to our Service (such as issue reports and photos). However, by submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute such content for the purposes of providing and improving our Service and sharing with municipal authorities for issue resolution.

9. Service Availability and Maintenance

We strive to provide continuous service availability but cannot guarantee 100% uptime. Our Service may be temporarily unavailable due to maintenance, technical issues, server problems, or other factors beyond our reasonable control.

We reserve the right to perform scheduled maintenance on our systems. Where possible, we will provide advance notice of planned maintenance that may affect service availability. We may modify, suspend, or discontinue any aspect of our Service at any time without prior notice. We are not liable for any modification, suspension, or discontinuation of the Service.

10. Disclaimers and Limitations

Our Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

While we strive to provide accurate information, we do not warrant that the information on our Service is accurate, reliable, or complete. Users should verify information independently before making decisions based on our Service. We do not guarantee that reported issues will be resolved by municipal authorities.

Our Service may contain links to third-party websites or content. We are not responsible for the content, accuracy, or availability of such third-party resources.

11. Liability Limitations

To the fullest extent permitted by applicable law, Aviatech Solutions LLP, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

Our total liability to you for all damages, losses, and causes of action shall not exceed the amount you paid to us in the twelve (12) months preceding the claim, or INR 10,000, whichever is less.

Some jurisdictions do not allow the exclusion of certain warranties or the limitation of liability for consequential or incidental damages. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.

These Terms shall be governed by and construed in accordance with the laws of India, without regard to its conflict of law provisions.

Any legal action or proceeding arising under these Terms will be brought exclusively in the courts of India, and you hereby consent to the jurisdiction of such courts.

We encourage you to contact us first to resolve any disputes. If informal resolution is unsuccessful, disputes will be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 2015.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website unless otherwise specified. We will notify users of significant changes through our website, email, or other appropriate means.

Your continued use of the Service after changes constitutes acceptance of the new Terms. It is your responsibility to review these Terms periodically for changes. If you do not agree to the modified Terms, you must discontinue use of the Service.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms.

Upon termination, your right to use the Service will cease immediately. All provisions of these Terms that should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.
